Uttarakhand crisis: HC paused by SC!

The Supreme Court Friday stayed the Uttarakhand High Court’s judgment till 27 April 2016 to quash the decision of the Center for the imposition of the President’s rule in the state of Uttarakhand.

Restoring President’s rule, A bench of justices Shiva Kirti Singh and Dipak Misra, blocked the revival of Congress government led by Harish Rawat, temporarily. The Centre’s undertaking was also recorded by the court about not revoking President’s rule until 27 April 2016. It is the next date of hearing, when a call would be taken on floor test on 29 April 2016, in accordance with the order of the High court.

Expressing displeasure at HC for not releasing out written judgement, the bench said, “What has been happening is a very serious and grievous matter for any state...you don’t revoke President’s rule just like that. Everything has to be looked into...a balance has to be struck.”

Justice Singh, who spoke for the bench, said: “If I were the High Court judge, I would have made my judgment operational only after three or four days when it is signed and ready. It is more on propriety than legality. Governance of a state cannot be left in the lurch.”

“Interference by a constitutional court in exercise of its power of judicial review pertaining to justifiability of Presidential proclamation is a serious issue... We will take on record the copy of the judgment and go through it. This matter may go to a Constitution bench,” observed the bench.
