Broadband and Mobile Data Services Restored in J&K January 25, 2020 10:48

Jammu and Kashmir has been shut off from the internet for six months now as the services were snapped on 4th of August last year, hours before the Article 370 has been abrogated.The administration of Jammu and Kashmir has ordered the restoration of broadband and data services on Friday mentioning that the services of broadband and the the mobile internet services at 2G speeds will be restored from Saturday for the Union Territory. However, the restrictions on the social media is said to be continued at least until 31st of January.Although the broadband connectivity to essential services has been restored on January 15, and the restricted data access has been restored in the North Kashmir districts of Kupwara and Baramulla, the data connectivity services were still snapped in the other places of the union territory until the administration of Jammu and Kashmir has announced the restoration of the services on Friday.The Supreme Court has directed the administration of Jammu and Kashmir in reviewing all the orders that has been suspended regarding the internet services while it ruled that the freedom of speech and expression and the freedom of practicing any profession or in carrying any trade, business or occupation over internet being the medium enjoys Constitutional protection under the Article 19 (1) (a) and Article 19 (1) (g).The notification from the home department says that the limitation of the internet access will be made where in the internet access shall be limited to only the whitelisted sites. The whitelisted sites has been expanded from the earlier being 153 that included the websites under the categories of mail, services, education, banking, travel, employment being few among the others, to 300 where in 53 new portals has been added and the restriction on the social media websites which allow peer to peer communication and Virtual Private Network Application will still persist.The prior 153 whitelisted websites included emailinmg sites such as gmail and outlook and 15 banking websites like reserve Bank of India, J&K Bank, PayPal and Western Union, three websites that are based on employment, 38 educational websites that includes indiaresults, IGNOU and websites for the five J&K based universities, three schools and Wikipedia.The mobile internet data services shall be made available on pre- paid as well as post- paid sim cards. It has also been mentioned that the restoration of the 2G internet facility will be made available and would be continued till 31st of January after which it would be further reviewed.The internet and mobile connectivity has been snapped on August 5 last year after the center has announced the abrogation of Article 370 of the constitution that has been made applicable to the former state of Jammu and Kashmir and has also bifurcated the state into two union territories with Jammu and Kashmir as one union territory and Ladakh being the other union territory.By Shrithika Kushangi

India Rejects Trump’s Latest Offer to Help in the Kashmir Issue January 24, 2020 10:37

The President of United States Donald Trump has offered help in resolving the Kashmir dispute after he has talks with the Imran Khan who is the Prime Minister of Pakistan on the sidelines of the World Economic Forum in Davos on Tuesday.The Ministry of External Affairs has denied this offer that has been made by the United States President saying that there was no role for a third party to mediate in the matter.The US President Donald Trump has said that the United States has been closely watching the developments between India and Pakistan over Kashmir and the relationship that is being shared between India and Pakistan and the United States is prepared to help regarding the same.Raveesh Kumar who is the spokesperson of Ministry of External affairs said in a press conference that there would be no role for any third party to mediate in the Kashmir issue. The government of Maharashtra has approved the policy ‘Mumbai 24 hours’ on Wednesday. The policy allows malls, multiplexes and shops to remain open 24 * 7 in the city from January 27.The ministers of Maharashtra Anil Deshmukh and Aaditya Thackeray has made the official announcement on Wednesday as they said that malls, shops, eateries, multiplexes in the non-residential areas like BKC, Nariman Pointremain can be remained open round- the- clock from January 27.The state tourism minister of Maharashtra Aaditya Thackeray has told the reporters that this policy that has been decided by the government could help in generating more revenue and jobs and would add up to the already existing 5 lakh people who are working in the service sector.He added saying that it is not a compulsion for the shops, malls and eateries in keeping them open all night but only the ones who feel that they can do good business can agree in keeping their business open round- the- clock.The policy is said to be a phase wise policy in which the first phase would comprise of the allowance of shops, eateries and theaters in malls and mill compounds that are located in the non-residential areas to remain open all night.The Shiv Sena leader has said that a lane will be opened for food trucks in the Bandra Kurla Complex and Nariman Point near NCPA which will be inspected by the food inspectors who would make sure that the rules on solid waste management, decibel limits and law and order will not be violated and if done so, the owners would be liable of lifetime ban.He added saying that the pubs and bars will be closed as usual at 1:30 am as the excise rules have not been touched.However, the move made by the government of Maharashtra has been slammed by the Bharatiya Janata Party (BJP) with the leaders of BJP saying that this policy of keeping Mumbai open round- the- clock would increase the number of cases regarding crimes against women and is against the Indian culture. Encounter Breaks out Between Militants and Security Forces in J&K January 22, 2020 18:43

The militants and the security forces in Jammu and Kashmir are engaged in an encounter in the Awanitpora region of Kashmir. An officer has said that a cordon and search operations have been launched by the Security forces in Khrew as the information has been gained about the presence of militants in the area.The joint operation is said to be carried by the Central Reserve Police Force (CRPF), the Rashtriya Rifles of the Indian army and the police of Jammu and Kashmir.The encounter has started after the militants opened a fire and it has been reported that there was a brief exchange of fire which led to the bringing in of additional forces.The encounter has killed three Hizbul Mujahideen terrorists which included a police deserter, in Shopian district, earlier in the day.The Jammu and kashmir police has tweeted saying that the encounter has started at Awantipora.A petrol bomb was hurled at the the security forces in the Pulwama district of Jammu and Kashmir on Monday evening, by the militants. Supreme Court to Hear Petitions Filed Against CAA January 22, 2020 10:28

The Supreme Court to hear today around a whopping 144 petitions related to the Citizenship Amendment Act (CAA) which includes the petitions that challenges the constitutional validity of CAA and transfer petitions filed by the Central Government.A three- judge bench would be hearing the petitions with the most petitions being to withdraw the law. Chief Justice SA Bobde would lead the three- judge bench.The petitions claim that the new law that has been passed stands against the basic structure of the constitution and is illegal. The petitions say that the right to equality will get demolished as the law is seeking to grant the citizenship on the basis of the religion.The petitions have been filed by several political parties and the key political parties being the Congress, the DMK, CPI, CPM, Indian Union Muslim League or IUML, Asaduddin Owasi’s All India Majilis- e- Ittehadul Muslimeen and Kamal Hassan’s Makkal Needhi Maiam.A plea has been made that the citizenship law should be declared constitutional which had been refused by the bench in the court on January 9 as it said that the efforts of the country should now be in attaining peace as the country is facing difficult times as that the job of the court is not to declare whether the law is constitutional but it is to determine the validity of the law, says the bench of which Justices BR Gavai and Surya Kant has been a part.A notice has already been issued to the center by the top court as it seeks the response of the center on the issue. The center has responded with a request for transferring similar cases that had been filed in the high courts to the Supreme Court.The government says that the Citizenship Act has been amended as it seeks to grant the citizenship of India to all the non-Muslim religions i.e., Hindus, Christians, Sikhs, Parsis, Jains, Buddists who have been as religious minorities in the three neighboring countries namely Pakistan, Afghanistan, Bangladesh facing religious persecutions there and who have come to India on or before December 31, 2014.The people who are protesting against this law fears that the law would be discriminating the people based on their religion as it said that the Muslim communities from the countries of Afghanistan, Bangladesh, Pakistan would not be granted with the Indian Citizenship and there would be violating the secular principles of the constitution.By Shrithika Kushangi

SC on Rajiv Gandhi Assassination Case January 21, 2020 13:17

The Supreme Court has asked the Government of Tamil Nadu to file a detailed status report regarding the issue of releasing the convicts of the Rajiv Gandhi assassination, within two weeks. The Supreme Court has posted the matter for further hearing after two weeks.A notice has been issued by the apex court to the CBI and has asked it to file a response within three weeks of the application which has been filed by A G Perarivalan who is the convict in the assassination case of Rajiv Gandhi.A G Perarivalan was initially awarded death sentence in the case which was later changed to imprisonment for the lifetime.Former Prime Minister Rajiv Gandhi was assassinated on May 21 in the year 1991 at Sriperumbudur in Tamil Nadu, during the night, by a woman suicide bomber at a poll rally. The woman has been identified as Dhanu. This attack has killed fourteen others which also included Dhanu herself.The death sentence for the four convicts had been upheld by the top court in May 19999. the convicts of the assasination case were identified as Perarivalan, Murugan, Santham and Nalini.In April 2000, the then governor of Tamil Nadu has commuted the death sentence of one of the four convicts, Nalini on the recommendation of the state government and an appeal was also made by Sonia Gandhi who was a former Congress president.The death sentence of Perarivalan has also been commuted to life imprisonment on February 18, 2014 along with two other prisoners, by the top court on the grounds of delay off 11 years in taking the decision regarding their mercy pleas by the Center. The other convicts whose death sentence has been commuted along with Perarivalan were Santhan and Murugan. Perarivalan has said in his application that he has been held guilty for supplying two nine-volt batteries which were allegedly used in the improvised explosive device (IED) that killed Rajiv Gandhi while the Multi- Disciplinary Monitoring Agency (MDMA) which is headed by a CBI official, is investigating relating to improvised explosive device.Regarding the issue of release of the convicts of the Rajiv Gandhi assassination case, the Supreme Court has now asked Tamil Nadu Government to file a detailed status report within two weeks and the matter has been posted for further hearing after the two weeks that has been provided.By Shrithika Kushangi

“A Non profit” has released a report on Monday which stated that India has ranked 5th among the countries that have been surveyed for the corporate commitments to the science-based targets.The report says that betterment in the disclosure of climate change risk from the Indian companies are being demanded by the investors which in turn spurred better disclosure from India Inc.The activities based on the reduction of carbon has been examined by the Carbon Disclosure Project (CDP) India annual report, which showed 58 Indian companies of the 59 firms that have been surveyed between the years 2018 and 2019, have board-level oversight of the issues related to climate which seems like 98 percent firms have climate- related issues.The report has said that committees and members have been designated to almost all the boards of top Indian companies, in order to address the climatic risks as it has been ensured by the increasing climate activism and the climate- conscious investors which is a growing band.The report shows India being the fifth country and with maximum number of companies being committed to SBT, it has been said to be the first country in developing the economy.The Director CDP India, Damandeep Singh has said that the companies are being engaged by the scores of the investors in order to disclose the risks in the climate and help them in doing better.It has been found that the environmental data has been disclosed by over 6,900 companies with over 55 per cent of global market capitalisation, through CDP in 2018.The list consisted of the US and Japan topping the list with 135 and 83 companies, the country that ranked third was UK with 78 countries and the fourth place was bagged by France with 51 companies.The report says that, 38 companies have been committed to SBT by December 2019 which shows a significant growth from the year 2018 being at 25 countries.According to the report, the climate concerns in performance evaluation of key personal have been integrated in India by the top corporate managements where in incentives have been provided for meeting the targets.The researchers have said that around 57 of the 59 responding companies in 2019 have stated that they have a process for assessing the risksBy Shrithika Kushangi

Nirbhaya case: SC Dismissed the Convict’s plea Claiming Juvenility January 20, 2020 16:04

One among the four convicts in the Nirbhaya case has claimed that he was a juvenile at the time of commission of the offence which has been rejected by the Supreme Court today. The convict, Pawan Kumar is said to be hung on February 1. The Delhi High Court has rejected the plea of Pawan Kumar earlier.The Supreme Court has said that, there exists no ground to entertain the petition that has been filed as once the examination of the issue regarding the juvenile has been rejected by the courts, it cannot be raised again. The advocate who has appeared for Pawan has argued that, the convict was a juvenile at the time the crime was committed. AP Singh has argued that, his school certificate is the proof that he was a minor and no court has ever considered the documents of Pawan.Solicitor General Tushar Mehta has said that Pawan was 19 years old at the time of the offence and there exists certified copies of his birth certificate as well as the certificate of the convict leaving the school which was taken on record by each and every judicial forum.The police has also said that, the parents of Pawan had confirmed his age and has agreed with no dispute that he was above 18 when the incident of Nirbhaya being gang-raped, tortured and killed had taken place in December 2012.Six men were arrested in the Nirbhaya case out of which one was said to a juvenile and has been released after three years in reform home. Pawan Gupta has filed a complaint on Friday saying that he was a minor when he was indulged in the Nirbhaya crime. The complaint has been filed when the date for hanging the four convicts has been announced. The date is confirmed to be on February 1 at 6 am.The Nirbhaya case is of a young woman who was gang-raped in a moving bus and was tortured by inserting an iron rod before being dumped on the road with severe internal injuries. The name of the woman has not been revealed and has been named as Nirbhaya who died two weeks later after the incident has taken place.
