Madras HC declines PIL against love marriages without parent's consent

Madras High Court on Saturday declined to entertain a PIL petition by K K Ramesh. He sought court’s order to forbear officials from solemnising love marriages without the consent and presence of parents of the bride and groom aspirants.
The petitioner moved court with an intention to check the honour killings. He sought a direction the government for issuing a circular or order for instructing the registration, police and temple officials to perform marriages only personal appearance and consent of the parents agreeing the marriage of the girl and the boy.
Chief Justice Sanjay Kishan Kaul and Justice S Tamilvanan ruled out the possibility of issuing such a direction, saying it would amount to the court making a new law and the court clearly stated that courts cannot intervene in such cases, major boy and girl can go for marriage if every condition satisfies.
