Texas Sanctuary City Law Challenged In Federal Court

A small border town and also some largest cities in the Texas told a federal judge on Monday that a new state law aimed at punishing the sanctuary cities, which could lead to an immigration police state and asked the judge to halt it, as it was unconstitutional.

The Republican proposed law in Texas, will take effect from 1st September. It is the first law of this kind since the Republican Donald Trump has become president in the month of January, promising to crack down on the illegal immigration.

The law, known as the Senate Bill 4, calls for jail for the police chiefs, sheriffs and also possibly frontline officers who fail to cooperate with the U.S. immigration. The law also allows the police to ask about immigration status during the lawful detention.

A lawyer for Texas said that the law helps to ensure conformity all across the state on the application of immigration law and also prevents localities from adopting the positions of non-cooperation along with federal authorities.

But an attorney for the American Civil Liberties Union, Lee Gelernt, who represents the plaintiffs, said that if the court upholds the Texas law it could have the national ramifications.

Other cities which sued to block the law include Austin, Dallas, Houston and also San Antonio.

Plaintiffs also contended that the law could lead to racial profiling and also divert resources from the local police who would go under the threat of job loss and fines if they do not cooperate with the federal immigration authorities.

Several hundred of protesters have rallied against the law outside the court. A decision in the case has not been likely to come soon.

Senate Bill 4 supporters have said that the immigrants who do not break the law have nothing to fear foe. Critics contend that Senate Bill 4 allows the police to detain people for up to 48 hours for various immigration checks, even for the minor infractions like jaywalking.

On Friday the Trump administration has filed court papers to support the Texas law, which said that it will help to keep America safe. A U.S. Department of Justice lawyer told to the court on Monday that the Texas law will ensure to co-operate with immigration matters.
