Three Important Bills in Lok Sabha: Replaces IPC, CrPC

Union home minister Amit Shah on Friday introduced three bills which are aimed to remove the British imprints from the criminal justice system. Indian Penal Code, the Indian Evidence Act and the Code of Criminal Procedure Indian Penal Code will not be introduced as the Bharatiya Nyaya Sanhita (BNS) bill 2023, Bharatiya Nagarika Suraksha Sanhita (BNSS) Bill 2023 and Bharatiya Sakshya (BS) Bill 2023.

BNS Bill highlights the removal of Section 124 A, currently, the bill has been sent to the Parliamentary standing committee on home affairs for detailed scrutiny.

The Bill lists new offences such as secession, armed rebellion, separatist activities or acts or whichever endangers the sovereignty or Unity and Integrity of India. The definition of documents will also be expanded to server logs, computers, smartphones, laptops, SMS, websites, emails, messages available on devices, and digital records.

The entire process of FIR will be digitised starting from the case diary to the charge sheet. The complete trial will be through video conference. Which is the entire session including the investigation, recording of evidence and witness will be digitized. Videography has been made compulsory. The bill also introduced a penalty for the first time for petty offences rather than imprisonment. Many like these changes were made in the new bill. The details will be out once the bill is out from the home affairs.
