Indian Government implements Four Labour Codes

In a significant change to India's labor laws, the government announced on Friday that it has put into action all four labor codes, replacing 29 current laws in what officials are calling the biggest reform in this area since the country became independent. The new Codes—related to Wages, Industrial Relations, Social Security, and Occupational Safety and Health—are now in effect from today. This update combines old labor regulations from many different laws into one streamlined system. A lot of these outdated laws originated before Independence or shortly after, and they were viewed as obsolete for an economy that has rapidly evolved and adapted to new kinds of work. The government explained that the new system aims to make it easier for employers to follow the rules and to broaden social security and workplace protections for a larger portion of India's workers, including those in gig jobs, contracted positions, fixed-term contracts, and employees working in small to medium businesses, plantations, mining, textiles, IT, and the audio-visual industry among others.

With these new rules, fixed-term employees will qualify for gratuity after a year, social security will cover small and medium enterprises, gig workers will receive official recognition for the first time, and various industries will now have required annual health check-ups, clearer safety regulations, and guarantees for timely wage payments. Moreover, women will be allowed to work night shifts in all sectors with their agreement and safety measures in place. The framework brings about numerous changes to enhance workplace protections and simplify compliance for businesses. A single-registration and single-return method replaces the need for various filings. Inspectors will serve more as guides instead of just enforcing penalties. A national minimum wage will guarantee that no employee earns less than a government-set level, while rules on equal pay will prevent discrimination against all workers, including transgender people.

Workers in plantations, beedi manufacturing, docks, mines, and dangerous industries will now have consistent safety and social-security standards for the first time. Workers in the audio-visual and digital media sectors, such as journalists and creators in electronic and streaming platforms, will receive formal appointment letters that outline their pay, responsibilities, and rights. The government asserted that these Codes were completed after thorough discussions and that public input will be sought while developing specific rules and plans. During the transition phase, existing laws and regulations will continue to be effective where necessary. Social security in India has increased from an estimated 19 percent of the workforce in 2015 to over 64 percent in 2025. The government stated that launching the four new Labor Codes represents the next step in this growth, aiming to create a more flexible, inclusive, and contemporary labor environment that benefits both workers and businesses.
